Abma’s Farm Terms, Conditions, and Cancelation Policy

BARNYARD PETTING ZOO

Tickets are required for entry for all individuals ages 2 and up. Ticket prices are subject to change without notice.
Children under the age of 2 (24 months) are free of charge and do not need a ticket. Once your child has had their 2nd birthday, they must have a ticket for entry.

Buyer must select time and date while purchasing ticket. Exclusions: Green Barnyard Booklet ticket holders need not select a day and time if entry is between operating hours and must surrender ticket(s) at entry. Additional Exclusions: Grandparents are free of charge on Wednesdays and do not need a ticket if entry is between operating hours on Wednesday.

Refunds or exchanges will not be given due to tardiness, failure to appear, illness, failure of taking advantage of service, or inclement weather.

Barnyard ticket(s) are not shipped. Buyer must check in at Barnyard Booth with ticket(s) or the name the tickets were purchased under to take advantage of ticket(s) and service(s) purchased.

Ticket holder has a 30-minute window to check in at the Barnyard Booth after the time specified on the ticket(s). Early or tardy arrivals will not be accommodated. Present ticket or name ticket(s) was purchased under to the cashier at the Barnyard Booth.

Barnyard is open RAIN OR SHINE, outside.

Outside food is NOT permitted in the Barnyard Petting Zoo for the safety of our animals. Bags are subject to search. Alcohol is NOT permitted in the Barnyard Petting Zoo.

Animal crackers, feed buckets, and feed pellets are available for purchase inside the Barnyard. Purchase of animal food is nonrefundable. For the safety of our animals (to avoid overfeeding), there is a limit of 2 crackers per person or 10 per family.

PONY RIDES

Pony Rides are located inside the Barnyard Petting Zoo and subject to Barnyard Petting Zoo’s Terms and Conditions.

Tickets are required for entry. Ticket prices are subject to change without notice. All Pony Ride Ticket holders MUST also have a Barnyard ticket for entry.

Refunds or exchanges will not be given due to tardiness, failure to appear, illness, failure of taking advantage of service, or inclement weather.

Pony ride ticket(s) are not shipped. Buyer must check in at the Pony Ride station with ticket(s) or the name the tickets were purchased under to take advantage of ticket(s) and service(s) purchased.

For the safety of our animals, Pony Ride tickets are valid only for participants ages 2+ and weighing 80 lbs. or less. Refunds will not be given if pony ride ticket is purchased for an individual who does not fit the criteria.

Pony Rides take place RAIN OR SHINE, outside.

Pony Ride Release and Waiver, Assumption of Risks, Disclaimer of Warranties, and Indemnification:

Assumption of Risk
You (customer) certify that you have the authority to bind and agree on behalf of all participants to the following in its entirety:
You understand and acknowledge that the Experience(s) you sign up to do may be hazardous and may carry the risk of injury, illness, or death, including but not limited to physical injury.
To the maximum extent permitted under applicable law, you knowingly, voluntarily and freely assume all risks, both known and unknown, of participating in each Experience, even if those risks arise from the negligence or carelessness of the Host(s) or others, or defects in the equipment, premises, or facilities used during the Experience, or otherwise, and you assume full responsibility for participation in the Experience.

Release and Waiver - You acknowledge and agree that:
You certify that you have the authority to bind and agree to accept these conditions on behalf of all participants.
All participants in the Pony Ride Experience are 80lbs or less.
Supervising adult/parent of participant is responsible for physically lifting participant on and off animal.
If participant is not fully comfortable sitting upright by themselves on the animal, supervising adult/parent of the participant is responsible for walking alongside the animal, physically holding up participant.
You have reasonably assessed the risks involved in the Experience(s) and have made an informed and voluntary choice to participate.
You alone, and not your Host(s), are responsible for determining your fitness for participating in the Experience(s) and your ability to fully understand any directions or warnings presented.
You will not participate in any Experience(s) when you have a physical, medical, or mental limitation or disability, or when you are aware or should reasonably be aware of any factors that may limit or prevent you from safely participating in that Experience(s).
You will act reasonably and responsibly and will comply with any provided and customary conditions, and/or precautions for participation in the Experience(s). If you notice any hazard during an Experience, you will stop participating in the Experience immediately.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU RELEASE AND PROMISE NOT TO SUE YOUR HOST(S) FOR ANY CLAIMS, DEMANDS, CAUSES OF ACTION, LOSSES (WHETHER ECONOMIC OR NON-ECONOMIC), DAMAGES, EXPENSES, COSTS OR LIABILITY OF ANY NATURE WHATSOEVER ARISING FROM OR IN CONNECTION WITH YOUR EXPERIENCE(S), WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY.

Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOSTS PROVIDE THE EXPERIENCE(S) “AS IS”, WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. WITHOUT LIMITING THE FOREGOING AND TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOST(S) EXPRESSLY DISCLAIM ANY WARRANTIES OF SAFETY, FITNESS FOR A PARTICULAR PURPOSE, QUIET ENJOYMENT, AND AS TO THE ADEQUACY OF THE DIRECTIONS AND WARNINGS PROVIDED TO YOU.

Indemnification

YOU AGREE THAT IF, DESPITE THIS RELEASE AND WAIVER, YOU OR ANYONE ON YOUR BEHALF MAKE A CLAIM AGAINST THE HOST(S) RELATING TO AN EXPERIENCE, YOU WILL INDEMNIFY AND HOLD THE HOST(S) HARMLESS FROM ANY LIABILITY, DEMAND, LOSS, DAMAGE, OR COSTS WHICH THE HOST(S) MAY INCUR AS THE RESULT OF SUCH CLAIM.

YOU AFFIRM THAT YOU HAVE READ THIS RELEASE AND WAIVER AND FULLY UNDERSTAND THE ASSUMPTION OF RISK, RELEASE, WAIVER, AND CONSENT CONTAINED IN IT. YOU FURTHER UNDERSTAND THAT YOU HAVE ACCEPTED THIS RELEASE FREELY AND VOLUNTARILY AND WITHOUT INDUCEMENT.

In addition, you hereby acknowledge that you have read the following paragraph from the New Jersey Equine Activity Liability Act: WARNING: UNDER NEW JERSEY LAW, AN EQUESTRIAN AREA OPERATOR IS NOT LIABLE FOR AN INJURY TO OR THE DEATH OF A PARTICIPANT IN EQUINE ANIMAL ACTIVITIES RESULTING FROM INHERENT RISKS OF EQUINE ANIMAL ACTIVITIES, PURSUANT TO P.L.1997, c.287(c.5:15-1 et seq).

SPECIAL EVENTS

Includes but is not limited to Story Time, Photo Ops, Pumpkin Decorating, etc.

Special event ticket(s) are not shipped. Buyer must check in at the event with ticket(s) or the name the tickets were purchased under and stay for the duration of the event to take advantage of ticket(s) and service(s) purchased.

U-PICK / U-DIG EVENTS

Tickets are required for entry for all individuals ages 2 and up. Ticket prices are subject to change without notice.
Children under the age of 2 (24 months) are free of charge and do not need a ticket. Once your child has had their 2nd birthday, they must have a ticket for entry.

All ticket sales are final. Tickets are non-refundable and non-transferrable.

Refunds or exchanges will not be given due to tardiness, failure to appear, illness, failure of taking advantage of service, or inclement weather.

U-Pick ticket(s) are not shipped. Buyer must check in at the event with ticket(s) or the name the tickets were purchased under and stay for the duration of the event to take advantage of ticket(s) and service(s) purchased.

Ticket includes entry to U-Pick / U-Dig event and produce bags or containers. Ticket does not include produce picked or eaten during event. Patrons must pay separately for what is picked and/or eaten, cash only. Price of produce will be posted on our website as well as at the event. Price of produce is subject to change.

WORKSHOPS

Tickets are required for entry for all individuals. Ticket prices are subject to change without notice. All ticket and deposit sales are final. Tickets and deposits are non-refundable and non-transferrable. Refunds or exchanges will not be given due to tardiness, failure to appear, illness, failure of taking advantage of service, or inclement weather.

 

For workshops that require a pre-paid deposit:
Your deposit goes toward the final cost of your workshop. Final cost of the workshop is determined by the cost of the materials used and is due at completion.

Deposit is non-transferrable and non-refundable. Refunds or exchanges will not be given due to tardiness, failure to appear, illness, failure of taking advantage of service, or inclement weather. Unless otherwise advertised, workshop event takes place at our Greenhouse, rain or shine.

For workshops that require pre-paid in full:
Workshops that require pre-payment in full include all materials to complete workshop. Full purchase is non-transferable and non-refundable. Refunds or exchanges will not be given due to tardiness, failure to appear, illness, failure of taking advantage of service, or inclement weather. Unless otherwise advertised, workshop event takes place at our Greenhouse, rain or shine.

SUMMER CAMP

Tickets are required for entry for all individuals. Ticket prices are subject to change without notice. All ticket and deposit sales are final. Tickets and deposits are non-refundable and non-transferrable. Refunds or exchanges will not be given due to tardiness, failure to appear, illness, failure of taking advantage of service, or inclement weather.

FARM TO TABLE DINNER

Full ticket payment is due in advance at time of reservation. By making a ticket reservation, you are purchasing a service. This service includes a seat at the table, a wine tasting, wine glass, and five-course meal on the grounds of Abma’s Farm.

Ticket reservation cancellations must be no less than 14 days prior to the scheduled dinner and will be given a refund minus processing fees. Cancellations within 14 days of reservation are forfeit and refunds or credits will not be given.

It is the sole responsibility of the parties in the reservation to know the date and time of the ticket reservation they purchased. Abma’s Farm does not offer a refund or credit for inclement weather, tardiness, illness, or failure to appear. Abma’s Farm does not offer refunds or exchanges due to buyer not taking advantage of service. All parties in the reservation must check in at the Farm to Table event and be present for the duration of the event to take advantage of the service.

Farm to Table takes place on the grounds of Abma’s Farm rain or shine. Location of Farm to Table on the grounds will be adjusted accordingly in the case of inclement weather.

CRAFT/GIFT BUNDLES

Craft and gift bundles are made to order. Cancellations may be made providing a minimum of 72 hours are given prior to scheduled pick up and a refund will be given minus processing fees. All craft/gift bundles are available for pick up only. No physical items will be shipped or delivered. Abma’s Farm does not offer refunds or exchanges due to buyer not taking advantage of service.

HAYRIDES/SPECIAL HAYRIDE EVENTS

Tickets are required for entry for all patrons ages 2+. Ticket prices are subject to change without notice. All sales are final. Tickets are non-refundable and non-transferable.

Children under the age of 2 (younger than 24 months) are free of charge and do not need a ticket. Once your child has had their 2nd birthday, they must have a ticket for entry.

Refunds or exchanges will not be given due to tardiness, failure to appear, failure of taking advantage of service, or inclement weather.

Hayride ticket(s) are not shipped. Buyer must check in with Hayride attendant with ticket(s) or the name the tickets were purchased under to take advantage of ticket(s) and service(s) purchased.

Ticket holder has a 30-minute window to check in after the time specified on the ticket(s). Early or tardy arrivals will not be accommodated. Present ticket or name ticket(s) was purchased under to the Hayride attendant to take advantage of service.

Private Hayride- Please plan to arrive 10-15 minutes prior to the selected time. Your hayride leaves promptly at the ticket time selected. Private hayrides are for a maximum of 30 people, including children and adults. Children under the age of 2 are considered "lap sitters" and do not need to be included in the count.

Accessibility
Hayrides to the pumpkin patch are not wheelchair accessible.

SCHOOL HAYRIDE TRIPS

Tickets are required for entry. Ticket prices are subject to change without notice.

School representative must select the maximum number of participants expected to participate. There is a 60-person maximum per time slot. If school has more than 60 people (children, adults, teachers, aides), school representative will have to book the appropriate number of tickets into the next consecutive time slot.

Please notify Abma’s Farm of any changes to the headcount. Final headcount is due at least 1 week prior to scheduled hayride.

Overbookings will be refunded in the form of a check on the day of hayride. Any additions to the final headcount will need to be paid for in full on the day of hayride. A discrepancy of more than 5 people the confirmed headcount on the day of the hayride will result in a fee of one ticket cost per no show. Any additions to the final headcount on the day of the hayride are not guaranteed and may be turned away.

In the case of inclement weather, Abma’s Farm will reschedule the school group ride or issue a refund minus processing fees. It is up to the sole discretion of Abma’s Farm to cancel due to inclement weather. A final decision will be made the morning of by 8:00am. An Abma employee will promptly contact customer regarding cancelation or reschedule of school hayride.

BIRTHDAY PARTIES

Birthday Party non-refundable deposit is forfeit if cancelled and not transferred. Transfers must adhere to transfer policy below. Refunds will not be given due to tardiness, failure to appear, failure of taking advantage of service, or inclement weather.

Birthday Party non-refundable deposit is transferable toward another date if notice is given at least 45 days prior to the initial booking, and that another date on the booking calendar is available to reserve.

HOLIDAY FOOD ORDERS: THANKSGIVING, CHRISTMAS, EASTER

All holiday orders are made to order. Orders are available for pick up only during specified pick-up days listed on our website and chosen by the customer at checkout. No physical items will be shipped or delivered. It is up to the customer to pick up items on the date specified at purchase. If customer does not pick up items on the date selected, customer has failed to take advantage of the service purchased and will not receive a refund.

Any order changes or cancellations will be honored providing a minimum of 48 hours is given prior to selected pick up day. Pick up day is used as a guide for Abma’s Farm and can be easily changed for customer when customer emails or calls. If applicable to Abma’s Farm hours of operation, items may be picked up the following business day after missed pickup.

Refunds will not be given due to inclement weather, illness, failure to appear, failure to take advantage of service, or failure to edit or cancel order more than 48 hours prior to pick up date selected by customer.

Orders not picked up or without advanced notice will be forfeit and not given a refund.

GROCERY DELIVERY

All grocery delivery orders must be placed prior to 8am the day before intended delivery day.

All grocery delivery orders must be edited or cancelled no less than 48 hours prior to delivery day. Changes or cancelations received within 48 hours to delivery day will not be accepted.

All edits or cancellations must be approved by Abma’s Farm staff and accompanied by a corresponding email to customer.

Setup fee is added to all grocery delivery orders. Setup fee is subject to change without notice.

Grocery deliveries are delivered between 1:00pm-5:00pm. All orders are left at the front door unattended. By choosing that your order be delivered, you accept full responsibility for your order after it has been delivered unattended, including but not limited to any loss, theft, damage, or spoilage due to temperature sensitivity or other factors. Abma's Farm will not be held responsible for any produce that is compromised due to customer negligence. Abma’s Farm delivery driver is not authorized to return order for any reason.

SUBSTITUTION POLICY

Our goal is to always have our products in stock, but due to circumstances beyond our control, there may be a time when a product is unavailable. If we ever run out, we'll offer a substitute item or give you a refund for the specified item. An employee will inform you of any changes prior to delivery.

OTHER TERMS AND CONDITIONS

Alcohol is not permitted on our property. Exception: Tomasello Winery Tasting Room, limit alcohol consumption in the form of Tomasello wine to the tasting room only.

Strollers are welcome inside our Market, Greenhouses, and Barnyard Petting Zoo. Please note, Greenhouse floor is gravel; Barnyard Petting Zoo is paved, but with a sharp incline at the entrance. Strollers are not permitted on hay wagons and must be parked in designated stroller parking area. Do not leave valuables in your stroller if left unattended; Abma’s Farm is not liable in the case of stollen or damaged property.

Access Denied
We reserve the right to refuse admittance to any persons who are engaging in inappropriate behavior. This includes persons under the influence of alcohol or drugs, persons using foul language or obscene behavior, and persons carrying weapons.

Smoking or vaping is not allowed on our property.
